Contested Divorce

If you and your spouse are unable to agree to the terms of your divorce then you will have to proceed in court with a contested divorce. A contested divorce is initiated by one spouse filing a Complaint for Divorce. The other spouse then has 20 days to file an Answer to the Complaint. Two to three months after these documents are filed, the court holds an initial hearing. If both spouses retain an attorney, then often times the attorneys communicate during this period of time to discuss any interim issues that may need to be addressed.

A contested divorce can take 6-9 months to resolve and can be quite expensive, especially if it ends with a divorce trial. At Berkich Family Law, we encourage our clients to come to any agreements they can with regards to their divorce – whether it be regarding financial issues or custodial issues. However, we recognize that there are many issues that simply need to be decided by the court. In the event your divorce is contested, we will be your guide through the litigation process as well as your prepared, knowledgeable advocate in the courtroom.
